Our client, the Anti-Counterfeit Agency (ACA) is a specialized government agency established under the Anti-Counterfeit Act, No.13 of 2008. 

Its mandate is to educate and inform the public on matters relating to counterfeiting and to combat counterfeiting, trade and other dealings in counterfeit  goods, through co-ordination with national, regional and international organizations involved in combating counterfeiting.

The Agency is now seeking dynamic self-starters, with exceptional communication and IT skills, who will work flexibly in a small but highly professional team, respond imaginatively to a varied  and demanding range of tasks and have the ability to turn strategy into practical measures while mastering complexity and detail.

Head of Human Resource & Administration

Reporting to the Deputy Director, Finance & Administration, the Head of Human Resources will be in charge of the general aspects of human resource management and administration in the Agency; and provide a broad range of human resource and administrative management activities in support of the Agency’s operations.

Further responsibilities will include:
  • formulating and reviewing terms and conditions of service;
  • developing and reviewing training policies for staff;
  • liaising with legal division on matters of insurance cover for staff, assets and premises;
  • overseeing the sound recruitment, appointment, and retention of competent staff;
  • establishing and maintaining a registry for proper storage of the Agency’s documentation and files;
  • ensuring proper management of the staff retirement benefits scheme;
  • developing an effective and transparent performance management policy;
  • dealing with disciplinary issues and conflicts among staff;
  • developing and implementing succession plans; and
  • coordinating all transport activities for the Agency both internal and overseas.
Applicants must hold a Bachelors degree in Management, Social Sciences, Law, Finance, or Public Administration. 

A Masters degree and or a postgraduate diploma in Human Resources Management will be an added advantage. 

A minimum of five (5) years’ experience ¡n human resources management and administration, at least three (3) of which should be in a senior leadership and management position in either the public or private sector is required.

Head of Procurement

Reporting to the Deputy Director Finance and Administration, the Head of Procurement will manage the procurement process and supply base efficiently and effectively and develop strong relationships with other functions of the Agency in order to develop integrated purchasing strategies that support the Agency’s goals and objectives.

Other responsibilities include:
  • developing an annual procurement plan aligned to the agency’s overall plan and monitor its implementation;
  • developing and ensuring implementation of procurement policies and regulations;
  • overseeing preparation of invitation of bids, requests for proposals and quotations;
  • interviewing potential suppliers, where necessary, alongside relevant set committees;
  • coordinating sourcing strategies and developing a comprehensive list of pm-qualified suppliers for goods and services; and
  • Preparing and reviewing supplier evaluations / bid analysis, requests for awards and contract services in accordance with procurement laws and established rules and regulations.
Candidates must hold a Bachelors degree in Finance, Economics or Commerce (Supplies Management Option) or its equivalent from a recognized institution; a Masters degree in a relevant field from a recognized institution will be an added advantage. 

Membership of the Kenya Institute of Supplies Management and postgraduate qualifications ¡n purchasing and supplies management is mandatory. 

The ideal candidate should have served for at least five (5) years as a Senior Procurement Officer or in a comparable position.

Senior Legal Officer

Reporting to the Chief Legal Officer, Enforcement, Prosecutions and Legal Services, the jobholder will draft contracts and other legal documents, render opinions, evaluate and perform legal audits of documents received by the organization; and under the direction of the Chief Legal Officer, undertake civil and criminal prosecutions as well as represent the organization in judicial and other dispute resolution proceedings. 

Additional responsibilities will include:
  • Implementation of the provisions of the legislation administered by the Agency;
  • Compile cases and update legal data-base to record information on successfully completed prosecutions or other enforcement actions;
  • Prepare legal drafts and negotiate contracts, leases, formal agreements and other legal instruments between the Agency and other parties, participate ¡n settlement and arbitration of disputes to ensure compliance with Anti-Counterfeit Act and related statutory requirements;
  • Conduct legal research, develop concept papers, prepare legal briefs and opinions as well as develop effective defence strategies, arguments and testimony ¡n preparation for legal proceedings;
  • Attend court on behalf of the Agency and prosecute criminal matters ¡n both subordinate and superior courts of record.
Applicants should hold a Bachelors degree in Law (LLB), a Postgraduate diploma in Law from the Kenya School of Law, Admission to the Roll of Advocates and a current Practising Certificate. 

A Masters  degree in a relevant field will be an added advantage. 

A minimum of three years post admission experience is required.

Enforcement Officer 

(10 Positions) - (Ref No.:254/AA/FN)

Reporting to an Assistant Director, Enforcement and Prosecutions the Enforcement Officer will undergo an induction and training program of up to 3 months prior to being posted to the field as an Inspector or Prosecutor under the Anti-Counterfeit Act, or as an Analyst in the enforcement back-office function. 

They will ensure that enforcement, investigation and prosecution policies, strategies and procedures are in place and duly observed at all times. 

Analysts will be called upon to collect, compile and analyze information received from various sources to support robust enforcement activities. 

Other responsibilities include:
  • Drafting of charge sheets and filing cases ¡n courts;
  • entering goods into the inventory and transferring them into the counterfeit goods depot and ensuring safe custody of exhibits;
  • investigating complaints from intellectual property rights owners;
  • ensuring that witnesses attend court through witness summons;
  • assisting in conducting prosecution of cases and taking part ¡n compiling court files/cases;
  • conducting raids on premises suspected to contain counterfeit goods;
  • carrying out follow ups on cases of complaints on counterfeit goods;
  • sampling goods for testing and analysis and compiling reports on suspected counterfeit goods; and
  • managing information from various sources, collating and analyzing the same to produce actionable product to inform enforcement activities.
Applicants must have utmost integrity and a strong sense of mission and purpose to serve the public. 

They should hold an honors Bachelors degree in Law, Commerce, Social Sciences, Physical Sciences or equivalent degree from a recognized university and a certificate in a relevant professional course. 

They must demonstrate above average analytical, wring and presentation skills. 

The candidates should have a minimum of two (2) years experience in a structured and formal work environment; experience in research, investigations, forensic auditing and accounting as well as languages will be an added advantage.

Chief Legal Officer.

Reporting to the Deputy Director, Enforcement, Prosecutions and Legal Services the successful candidate will oversee the enforcement and implementation of the legislation administered by the Agency and advise and represent the Agency in legal proceedings.

They may also be called to deputise for the Board Secretary when called upon to do so. Key responsibilities include:
  • Coordinating the implementation of the provisions of all legislation administered by the Agency;
  • Advising and representing the Agency in legal proceedings;
  • Take minutes during board and management meetings when requested;
  • Compile weekly, monthly, quarterly and annual reports on all cases being handled by the Agency;
  • Negotiate Out-Of-Court settlements between parties where necessary;
  • Maintain a register on loans and debts by the Agency and staff;
  • Develop and implement training programmes for legal officers;
  • Prepare opinions, briefs, papers and memoranda and maintain a prosecutions register; and
  • Represent the Agency in court or attend court on behalf of the Agency and prosecute criminal matters in both subordinate and superior courts of record;
The ideal candidate will hold a Bachelors degree in Law (LLB) from a recognized university; a Postgraduate diploma ¡n Law from the Kenya School of Law and Admission to the Roll of Advocates. 

A Masters degree in Commercial Law, Business Administration, Economics, Finance or a related field will be a distinct advantage.


They should be a qualified CPS(K) and an Advocate of the High Court of Kenya with a minimum of five (5) years post-admission experience in providing legal services, of which at least three (3) years were as a Senior Legal Officer/ Prosecution Counsel or in a comparable position.

For the management positions candidates are required to have management competencies that will enable them to participate in the development of strategic plans, annual work-plans and budgets as well as exercise supervisory oversight over teams in order to improve performance standards and organisational effectiveness.

For all the positions, it is important that applicants are Kenyan citizens and persons of integrity with demonstrable high ethical standards which meet the requirements of Chapter Six of the Constitution of Kenya.

They must be computer literate with excellent knowledge of relevant computer software and applications as well as strong end user skills and proficiency in MS Office programs.
